The general purpose of probate is to collect all the assets of the deceased; liquidate the assets into cash; pay all outstanding debts of the deceased (including taxes) and then finally, to distribute the assets to the rightful beneficiaries of the deceased.
WHAT IS THE JOB OF A PROBATE LAWYER?
Why and When do you need Probate?
The general purpose of probate is to collect all the assets of the deceased; liquidate the assets into cash; pay all outstanding debts of the deceased (including taxes) and then finally, to distribute the monies or assets to the immediate spouse/children/siblings/relatives of the deceased.
The distribution of the assets is the final step.
If the loved one left behind a Will, the distribution must be done according to the Will of the deceased. In such a case, you need to apply to the court to obtain a Grant of Probate.
If the loved one did not have a Will, the distribution is done according to intestacy laws. In such a situation, you need to apply for Grant of Letters of Administration.
To put it simply, a probate lawyer’s job is to help the executor get the necessary court order to administer the estate and enable the beneficiaries to get their inheritance from the assets left behind by the deceased person.
PKWA Law Probate Lawyers
PKWA Law is one of the leading family law firms in Singapore. The team of experienced probate lawyers at PKWA LAW will prepare and file all the legal documents and make all the court appearances for you to obtain Grant of Probate or Grant of Letters of Administration in 4 to 6 weeks.
To get probate quickly, the executor should:
- produce the Will (if any).
- provide a list of all the assets. It would be best if you tried not to instruct a probate lawyer to find out what assets the deceased has. There are hundreds of financial institutions, and it is going to be very costly for you to ask a lawyer to investigate what assets the deceased has.
- prepare a complete list of beneficiaries (with their full names, address and NRICs).
Once we have obtained probate, you have to pay the deceased’s debts and distribute the assets to the rightful beneficiaries. This is an essential job of the executor/ administrator, and it must be carried out to avoid disputes.
